Pixfy provides a marketplace where businesses and individuals can connect with photographers, videographers, and content creators for booking creative services.

You agree to:

Use the Platform only for lawful purposes.
Provide accurate, current, and complete information when creating your account.
Keep your account information secure and confidential.

We reserve the right to suspend or terminate your access if you violate these Terms.

2. User Accounts

To book or offer services, you must register and create an account.
You are responsible for:

Maintaining the confidentiality of your login credentials.
All activities that occur under your account.

3. Services and Payments

All bookings made through Pixfy are agreements between users (clients) and service providers (content creators).
Pixfy may facilitate payments on behalf of creators through secure third-party payment processors.
You agree to pay all fees and charges associated with your bookings as described at checkout.

Pixfy is not a party to the actual service contract between users and creators.

4. Cancellation and Refund Policy

Cancellation policies vary by each creator and will be outlined during booking.
If a service is canceled by the creator or the client, refunds are subject to the individual creator’s stated cancellation terms.

Pixfy is not responsible for issuing refunds unless explicitly stated otherwise.

5. Content and Intellectual Property

All content on the Platform, including logos, branding, text, images, and software, is owned by Pixfy or its licensors and protected by copyright and other laws.

You may not:

Reproduce, distribute, or modify any content without our prior written consent.
Use our trademarks without permission.

6. User-Generated Content

You may post content such as reviews, profiles, or messages ("User Content").
By posting User Content, you grant Pixfy a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content in connection with the Platform.

You agree that your User Content:

Will not violate any third-party rights.
Will not be false, misleading, defamatory, obscene, or unlawful.

7. Disclaimers and Limitations of Liability

Pixfy provides the Platform "as is" without warranties of any kind.
We do not guarantee:

The availability, quality, or legality of services provided by creators.
That the Platform will always be secure, error-free, or available without interruption.

To the maximum extent permitted by law, Pixfy shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

8. Indemnification

You agree to defend, indemnify, and hold harmless Pixfy and its affiliates from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

9. Changes to These Terms

We may modify these Terms at any time. Changes will be effective when posted on our Platform.
Your continued use of the Platform after changes are posted constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of law principles.
By using our Platform, you agree that any dispute arising out of or relating to these Terms, your use of the Pixfy Platform, or any services provided shall be resolved exclusively in the state or federal courts located in New York County, New York, USA.

If you are accessing the Platform from outside the United States, you do so at your own risk and are responsible for compliance with your local laws.
